Restraining Orders

This section defines domestic violence for the purposes of getting an injunction for protection against domestic violence.

Domestic violence is when the abuser committed any of these acts against a family or household member:

• assault;
• aggravated assault;
• battery;
• aggravated battery;
• sexual assault;
• sexual battery;
• stalking or aggravated stalking, which includes harassment and cyberstalking;
• kidnapping;
• false imprisonment; or
• any criminal offense resulting in physical injury or death of one family or household member by another family or household member.¹

If you are the victim of domestic violence or if you have reasonable cause to believe that you are in immediate danger of becoming the victim of any act of domestic violence, you can apply for an injunction against domestic violence.²
